The law states in Tex. Bus. Comm. Code §17.50 that people like me have a claim for damages against someone like Van Chevrolet if they violate any portion of Tex. Bus. Comm. Code §17.46 Tex. Bus. Comm. Code §17.46 states specifically that Van Chevrolet cannot engage in "advertising goods or services with intent not to sell them as advertised." So in this case, Van Chevrolet advertised the vehicle (The Bait) at a price of $6,988.00, but in violation of §17.46 they clearly had no intention of selling the Bait at that price.  Instead, they intended to switch me to another vehicle after luring me to the dealership.  In this case a Kia.  Knowing a bait and switch when I see one, I just left. But what are my damages?  What money could I win?  Not a lot, but I did suffer damages.  I wound up buying a comparable vehicle for $9,950.  So I am out at lest 3,000.  The law also states that if Van Chevrolet knowingly violated §17.46 that I am entitled to treble damages.  So that runs the price up to $9,000. In addition, I am entitled to attorney's fees. So that would push the number way higher.   My real interest, if I choose to go forward legally, is to bring a class action suit. How many people have they lured there on false pretenses and then either switched them to another vehicle or sold them something else?  That is what intrigues me, if going forward legally were my goal. For now, my only interest is in letting the public know what happened to me. But I do have young lawyers at the firm the need to be kept busy. So who knows?
